A recent change in legislation means that ICM are now able to accept claims for UK residents injured whilst travelling within the EU.
In the past this type of claim has been fraught with difficulty. The claim had to be made in the country where the accident occurred, using local (possibly non-English speaking) lawyers and often involving considerable cost. As a result many perfectly legitimate claims had to be abandoned.
The fourth and fifth EU directives now permit claims to be made using the jurisdiction of the injured party's country of residence, provided the third party insurer is based in the EU.
This is a similar situation to making a claim against a foreign driver for damages caused in the UK. EU expansion and travel within it is increasing at a considerable pace and the potential for such claims is increasing by the day.
